We may change this Privacy Policy at any time without prior notice to you or any other person (via email or otherwise) by posting changes on the website. We encourage you to check back and review this Privacy Policy from time to time to remain fully informed of our commitments to your privacy.

Acceptance of Privacy Policy

We provide notice of our privacy practices in our Privacy Policy. Each time you access, use, browse, or submit an application, form or other information on Park Newport’s website, you signify your acceptance of our Privacy Policy.

If you provide Personal Information (defined below) to Park Newport offline, such as when you visit the management or leasing office at Park Newport, we ask that you review this Privacy Policy which also governs Personal Information collected offline.

Personal Information

For the purposes of this Privacy Policy, “Personal Information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer (e.g., an individual) or household.

Personal Information does not include:

·         De-identified or aggregated consumer information.

·         Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data.

·         Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA).

Categories of Personal Information Collected

The categories of information that we collect include:

How We Collect Your Personal Information

We collect Personal Information from you in the following ways:

·         Direct interactions with you. We collect Personal Identifiers, Contact Information, Personal Characteristics, Sensitive Information, Professional or Employment Information, Sensory Information, Financial information and Commercial or Customer Information when you complete electronic forms on our website or provide physical forms and other documentation in person.

·         Automated technologies or interactions. We collect various Online Device Information passively when you visit our website and online services through cookies, web beacons, and other similar technologies.

·         Third Parties. We collect additional Sensitive Information and Financial Information such as a credit reports from third parties with whom we have business relationships to assess rental applications.

 

How We Use Your Information

We may use your Personal Information for one or more of the following purposes:

·         We may collect Personal Identifiers, Contact Information, Personal Characteristics, Sensitive Information, Professional or Employment Information, and Financial Information from you to provide you services, to process and manage your interactions and transactions with us, and as otherwise related to the operation of our business. Related operations can include credit checks, verifying renter’s insurance coverages, and maintaining banking or credit/debit card information in connection with payment directions you have provided for rent, utilities, deposits, fees, or to facilitate security deposit refunds as needed.

·         We may collect Commercial or Customer Information in connection with services we provide you while you are living at one of our properties, in order to verify services were provided or to follow up with you about whether the services met your needs.

·         We may collect Online Device Information when you visit our websites for the purposes of improving your online experience, establishing secure user accounts, remembering your preferences and settings and similar customization purposes

·         We may collect Sensory Information through the recording of customer service calls and leasing or marketing calls that we have with you. Certain of our properties use video security technologies, and those videos may be stored for a period of time.

Information Sharing & Disclosure

Park Newport does not sell Personal Information collected through Park Newport Services, and no such sale has occurred in the prior 12 months.

Park Newport may provide Personal Information to third parties under limited circumstances, including service providers and vendors that support or integrate Park Newport services described in this statement. Park Newport only shares Personal Information to the extent reasonably necessary to support Park Newport requirements, or for the third-party vendors or service providers to perform the services on our behalf.

For example, we may disclose Personal Identifiers, Personal Contact Information, Sensitive Information, Professional or Employment Information, and Commercial or Customer Information to our credit reporting agencies who process the information for the purpose of managing apartment homes.

We do not permit third party vendors or service providers to use or disclose your Personal Information except for the purpose of providing the services we request of them.

In addition, if Park Newport enters any business transition, restructuring, merger, sale, or other transferring of assets, we reserve the right to transfer all Park Newport information, including all Personal Information, as part of or in connection with the transaction.

Finally, we will access, transfer, disclose, and preserve Personal Information when we have a good faith belief that doing so is necessary to:

·         Comply with applicable law or respond to valid requests by public authorities, including law enforcement, national security agencies, or other government entities.

·         Operate and maintain the security of Park Newport Services.

·         Protect the rights and property of Park Newport, including both intellectual property and physical systems infrastructure.

Cookies, Web Beacons, and Other Technologies

When you access our services or our website, our servers may place small text files (“cookies”) on your computer for recordkeeping purposes. Among other things, cookies enable us to gather information about your activity on our website for the purposes of improving your online experience, establishing secure user accounts, remembering your preferences and settings, and for other similar customization purposes.

In addition to cookies, the services on our website may utilize web beacons, clear gifs, or other technologies to gather information on how users interact with and utilize various features. For example, these technologies can identify popular pages, viewing patterns, click-through, conversion rates, and other information that can be used to improve, monitor, and operate our website, products, and services.

Do Not Track

We do not track our residents over time and across third-party websites to provide targeted advertising and therefore do not respond to Do Not Track (DNT) signals.

Park Newport implements and maintains appropriate physical, administrative, technical and organizational measures to protect the information we process against unauthorized or unlawful access, use or disclosure, and against accidental loss, damage, alteration or destruction.

Under our security policies and practices, access to Personal Information is restricted and authorized only for those who have a business need for such access. Park Newport strives to protect the Personal Information that we process; however, no security program is 100% secure and we cannot guarantee that our safeguards will prevent every unauthorized attempt to access, use, or disclose Personal Information.

Accessing & Updating Personal Information

In the event your Personal Information is determined to be outdated, incomplete, or inaccurate, you may access and update your information by logging into your Park Newport account or contacting the administration office.

California Consumer Privacy Rights

This portion of our Privacy Policy advises California residents of the applicable rights as provided in the California Consumer Privacy Act (CCPA) and how to effectuate these rights by communicating with us. Under the CCPA, California residents have the following rights:

                 Right to know the Personal Information we collect about you, the categories of sources of Personal Information collected, the categories of sources from which Personal Information is collected, the business or commercial purpose for collecting or disclosing the Personal Information, the categories of third parties who have access to your Personal Information.

                 Right to request deletion of your Personal Information subject to certain exceptions. For example, we may deny your request if retaining your Personal Information is required under certain circumstances  such as: to complete the transaction for which we collected the Personal Information, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you; detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities; or comply with a legal obligation.

                 Right to opt-out of the sale of your Personal Information. However, since we do not currently sell your Personal Information, there is no need for you to opt-out.

                 Right to not face discrimination for asserting your rights. For example, we may not deny you goods or services, charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties, provide you a different level or quality of goods or services, or suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

 

Please note that we will verify your identity when we receive requests to access or delete your Personal Information to ensure the security of your Personal Information, which may require us to collect further information about you. You may also designate an authorized agent to make requests on your behalf.

Responding to Your Rights Requests

We try to respond to all legitimate and verifiable requests within forty-five (45) days. It may take us longer than 45 days if your request is particularly complex, you have made several requests, or additional information is needed from you to process your request. In this case, we will notify you within the 45-day period and keep you updated.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically. If we cannot comply with your request, we will explain the reasons why we cannot comply.

Please note, for access requests, we retain Personal Information for a set period of time and may not be able to provide Personal Information processed longer than a 12-month period prior to the date of the request. Additionally, we are not legally obligated to action a request to access your Personal Information more than twice in a 12-month period prior to the request date. 

You will usually not have to pay a fee to access your Personal Information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request under these circumstances.

Additional California Notices

In addition to CCPA rights, certain Californians are entitled to certain other notices. As these rights and your CCPA rights are not the same and exist under different laws, you must exercise your rights under each law separately.

Third Party Marketing and Your California Privacy Rights

We provide California residents with the option to opt-in or opt-out to sharing of “Personal Information” as defined by California’s “Shine the Light” law with third parties, other than with our affiliates, for such third parties’ own direct marketing purposes. California residents may exercise that opt-out, or request information about our compliance with the Shine the Light law, and obtain a disclosure of third parties we have shared information with in accordance with the law for their direct marketing purposes absent your choice (i.e., Company affiliates) and the categories of information shared, by contacting us at [email] or by sending a letter to California Privacy Rights Request, Park Newport Apartments, One Park Newport, Newport Beach, CA, 92660, (Attention: General Manager). Requests must include “California Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the provided e-mail address or mail address.
