that you provide to us or third parties on our behalf.

We provide notice of our privacy practices in our Privacy

other information on Park Newport’s website, you signify your acceptance of our

If you provide Personal Information (defined below) to Park
Newport offline, such as when you visit the management or leasing office at Park
Newport, we ask that you review this Privacy Policy which also governs Personal
Information collected offline.
For the purposes of this Privacy Policy, “Personal

capable of being associated with, or could reasonably be linked, directly or
indirectly, with a consumer (e.g., an individual) or household.

include credit checks, verifying renter’s insurance coverages, and maintaining
banking or credit/debit card information in connection with payment directions
you have provided for rent, utilities, deposits, fees, or to facilitate
security deposit refunds as needed.

Information in connection with services we provide you while you are living at
one of our properties, in order to verify services were provided or to follow
up with you about whether the services met your needs.

We may collect Online Device Information when
you visit our websites for the purposes of improving your online experience,
establishing secure user accounts, remembering your preferences and settings
and similar customization purposes

We may collect Sensory Information through the
recording of customer service calls and leasing or
marketing calls that we have with you. Certain of our properties use video
security technologies, and those videos may be stored for a period of time.
Park Newport does not sell Personal
Information collected through Park Newport Services, and no such sale has
occurred in the prior 12 months.
Park Newport may provide Personal Information to third
parties under limited circumstances, including service providers and vendors
that support or integrate Park Newport services described in this statement.
Park Newport only shares Personal Information to the extent reasonably
necessary to support Park Newport requirements, or for the third-party vendors
or service providers to perform the services on our behalf.
For example, we may disclose Personal Identifiers, Personal
Contact Information, Sensitive Information, Professional or Employment
Information, and Commercial or Customer Information to our credit reporting
agencies who process the information for the purpose of managing apartment
homes.
We do not permit third party vendors or service providers to
use or disclose your Personal Information except for the purpose of providing
the services we request of them.
In addition, if Park Newport enters any business transition,
restructuring, merger, sale, or other transferring of assets, we reserve the
right to transfer all Park Newport information, including all Personal
Information, as part of or in connection with the transaction.
Finally, we will access, transfer, disclose, and preserve Personal
Information when we have a good faith belief that doing so is necessary to:

We do not track our residents
over time and across third-party websites to provide targeted advertising and

Park Newport implements and maintains appropriate physical,

disclosure, and against accidental loss, damage, alteration or destruction.

Information is restricted and authorized only for those who have a business
need for such access. Park Newport strives to protect the Personal Information
that we process; however, no security program is 100% secure and we cannot
guarantee that our safeguards will prevent every unauthorized attempt to
access, use, or disclose Personal Information.
In the event your Personal Information is determined to be
outdated, incomplete, or inaccurate, you may access and update your information
by logging into your Park Newport account or contacting the administration
office.
This portion of our Privacy Policy advises California
residents of the applicable rights as provided in the California Consumer
Privacy Act (CCPA) and how to effectuate these rights by communicating with us.
Under the CCPA, California residents have the following rights:

Information is collected, the business or commercial purpose for collecting or
disclosing the Personal Information, the categories of third parties who have
access to your Personal Information.

For example, we may deny your request if retaining your Personal Information is

such as: to complete the transaction for which we collected the Personal
Information, take actions reasonably anticipated within the context of our

We try to respond to all legitimate and verifiable requests
within forty-five (45) days. It may take us longer than 45 days if your request
is particularly complex, you have made several requests, or additional information
is needed from you to process your request. In this case, we will notify you
within the 45-day period and keep you updated.
If you have an account with us, we will deliver our written
response to that account. If you do not have an account with us, we will
deliver our written response by mail or electronically. If we cannot comply
with your request, we will explain the reasons why we cannot comply.
Please note, for access requests, we retain Personal
Information for a set period of time and may not be able to provide Personal
Information processed longer than a 12-month period prior to the date of the
request. Additionally, we are not legally obligated to action a request to
access your Personal Information more than twice in a 12-month period prior to
the request date.
You will usually not have to pay a fee to access your
Personal Information (or to exercise any of the other rights). However, we may
charge a reasonable fee if your request is clearly unfounded, repetitive or

opt-out to sharing of “Personal Information” as defined by California’s “Shine
the Light” law with third parties, other than with our affiliates, for such
third parties’ own direct marketing purposes. California residents may exercise
that opt-out, or request information about our compliance with the Shine the
Light law, and obtain a disclosure of third parties we have shared information
with in accordance with the law for their direct marketing purposes absent your
choice (i.e., Company affiliates) and the categories of information shared, by

required to respond to requests made by means other than through the provided
